Abused women suffer a singular psychology that makes it impossible for them to step forward and participate in the social and legal processes society has put in place. It is a tragic irony that Molly Bowers Midyette had to be incarcerated before she found the safety she needed to speak out. Molly’s parents and her new lawyers have worked constantly to progress steadily through a slow legal system to obtain a motion for a hearing that would bring new information to bear on the circumstances of Molly’s initial trial. Stan Garnett, the Boulder District Attorney, indicated publicly his support for this process, but now has tried to have the hearing stopped. Mr. Garnett needs to honor his original position and not prevent Molly from obtaining the justice she deserves within our legal system.

Molly Midyette's son suffered 37 broken bones, and was the most gravely injured baby an emergency nurse had seen during her 27 year career. I am not aware of any broken bones on Molly Midyette's body when she remanded into custody after the guilty verdict returned against her. She stayed with Alex Midyette until the jail door cell slammed shut behind her, over a year past the time of her son's death. She lied for him about injuries to the baby when he was alive, when he could have gotten help that would have saved his life. She did not take her baby to get help, to the emergency room, or the police station, prior to his fatal injuries.
